Cher has been denied custody of his son’s funds for the time being


LOS ANGELES — A judge on Friday refused to immediately place Cher’s son in the legal guardianship she is seeking and opposing, but the court will hear the case again within weeks.

Los Angeles Superior Court Judge Jessica A. Ozcategui, stated that Scheer’s lawyers did not give Elijah Blue Allman and his lawyers the necessary documents to give them enough time to present their case, and another hearing was scheduled for January 29.

Last week, the Oscar- and Grammy-winning singer and actor filed a petition to take control of the finances of Elijah Blue Allman, 47, saying his struggles with addiction and mental health have left him unable to manage his money and potentially putting his life in danger. Allman receives the money from a trust left by his late father, musician Gregg Allman. Cher’s lawyer, Gabrielle Vidal, said at Friday’s hearing that payment from the trust is pending, and that the immediate establishment of a conservatorship is a “life or death proposition.”

But Uzcategui said: “I’m not convinced.”

She noted Scheer’s attorneys’ unwillingness to share the materials with Allman’s attorneys when contacted Thursday. Scheer’s lawyers said they had confidentiality concerns and instead shared the documents with Allman’s court-appointed attorney.

Allman said in a court filing before the hearing that guardianship was not necessary. He admitted to struggling with addiction and irresponsible spending, but said he is under a doctor’s care, has been sober for more than three months, attends Alcoholics Anonymous meetings, and is willing to submit to drug tests.

“Although I understand that my mother, the proposed conservator, believes she has my best interests at heart and I appreciate her love and support, I do not need her unwanted assistance or support at this time,” the filing said.

Allman was in court Friday but spoke only briefly to answer the judge’s questions. His lawyers declined to comment after the hearing.

Cher did not attend. Her lawyers did not immediately respond to a request for comment.
